Appeals Court Rules Against Providers in Florida Generator Case

On October 19, the First District Court of Appeals sided with Florida Governor Rick Scott (R), requiring long-term care facilities to install generators, and other resources, to maintain operation for up to 96 hours after a power outage.

LeadingAge Florida challenged the legality of the emergency rule, arguing that the 60 day timeline would be impossible to comply with.

According to McKnight's, nearly 150 nursing homes and assisted living providers have sought exemptions from the mandate. To date, there has not been any word on what next step LeadingAge Florida is moving forward on.
