CMS Issues Letter Detailing Nursing Home CMP Increases for 2017

The Centers for Medicare and Medicaid Services (CMS) has released Survey and Certification Letter No. S&C: 17-23-NH/HHA/CLIA, dated Mar. 31, 2017, that details the increase in civil monetary penalties (CMPs) for nursing home regulatory noncompliance pursuant to a final rule issued on Feb. 3, 2017.

Specifically, for 2017, CMPs have been increased by a multiplier of 1.01636. The increase is effective Feb. 3, 2017. The adjusted amounts apply to CMPs assessed on or after that date, when the violation occurred after Nov. 2, 2015. If the violation occurred on or prior to Nov. 2, 2015, or if the violation occurred after Nov. 2, 2015, but the CMP was assessed prior to Feb. 3, 2017, the CMP amounts in effect before the increase adjustment will apply.
